INIHAIN ang isang resolusyon nitong na naglalayong Lunes hilingin ang pagpapauwi kay dating Pangulong Rodrigo Duterte mula sa The Hague sa Netherlands kung saan siya kasalukuyang nakakulong.
Nakasaad sa resolusyon ni si Sen. Robinhood “Robin” C. Padilla na maipahayag ang “sense of the Senate” para dito, para sa pagkakasundo at pagkakaisa ng bayan, at para matutukan ng gobyerno ang mga pangunahing pangangailangan.
Layunin din ng resolusyon ang igiit ang soberanya ng Pilipinas, at ang karapatan nito na imbestigahan at usigin ang mamamayan nito.
“Resolved by the Senate, as it is hereby resolved, expressing the sense of the Senate urging the Philippine Government to secure the immediate repatriation of former President Rodrigo Roa Duterte, and thereafter resume or continue investigations into crimes related to his anti-illegal drug campaigns, and prosecute applicable offenses as warranted by the evidence to facilitate reconciliation and national unity; refocus government efforts to address pressing challenges such as poverty alleviation, infrastructure development, economic recovery, and climate change resilience; assert Philippine sovereignty; and reaffirm the exclusive right of the Philippines to investigate, prosecute, or hold accountable its citizens in accordance with its Constitution and legal system,” ani Padilla sa resolusyon niya.
“Resolved, further, that if full repatriation free from ICC jurisdiction is impracticable, the Senate hereby strongly urges the Philippine Government to secure, on an ad cautelam basis and without conceding ICC jurisdiction, the interim release of former President Duterte to the Philippines under conditions acceptable to the ICC (International Criminal Court),” dagdag niya.
Ihinain ni Padilla ang resolusyon Lunes ng hapon, nguni’t hindi ito tinanggap ng Senate Bills and Index section, dahil sa Rule 44 ng Rules of the Senate kung saan lahat ng bagay ay matatapos na sa pagtatapos ng Kongreso. Nag-adjourn sine die na ang 19th Congress.
Balak ni Padilla na ihain muli ang resolusyon sa 20th Congress na magsisimula sa Hunyo 30.
Sa resolusyon ni Padilla, iginiit ng Senado na walang Pilipino, lalo ang nagsilbi sa gobyerno ng 34 taon, ay dapat ikulong o litisin ng dayuhang husgado para sa mga krimeng nangyari sa Pilipinas.
Binanggit ni Padilla ang Article II, Section 7 ng 1987 Constitution na nagsasaad na: “(t)he State shall pursue an independent foreign policy”; as well as the Principle of Complementarity, enshrined in Articles 1 and 17 of the Rome Statute, that limits the ICC’s jurisdiction to cases where a State Party is unwilling or unable to genuinely investigate or prosecute crimes within its jurisdiction.”
“The Department of Justice (DOJ) and the Office of the Solicitor General have consistently and publicly affirmed that the Philippines maintains a robust criminal justice system, actively investigating and prosecuting alleged crimes related to former President Duterte’s war on drugs, thereby precluding ICC jurisdiction based on the Principle of Complementarity,” ani Padilla.
Dagdag niya, nag-withdraw ang Pilipinas sa Rome Statute noong Marso 16, 2018, at wala nang obligasyon bilang State Party dito simula Marso 17, 2019.
Binanggit din ni Padilla ang Sec. 17 ng Republic Act No. 9851, kung saan kailangan ang tratado para sa pagsuko ng indibidwal sa pandaigdigang tribunal.
Dagdag niya, ang Senado bilang kinatawan ng Pilipino ay hindi maaaring hindi pansinin ang suporta para sa dating Pangulo, na nanalo bilang alkalde ng Davao City nitong Mayo; o ang pagkapanalo ng kaalyado niya sa Senado.
Binanggit din ni Padilla ang mga rally na nananawagan para pauwiin ang dating Pangulo, at isang survey kung saan hindi sang-ayon ang karamihan ng Pilipino sa pagkaaresto sa kanya at pagsuko sa ICC.
Ayon din kay Padilla, binanggit ni Pangulong Ferdinand “Bongbong” Marcos Jr. sa podcast noong Mayo 19 kung saan sinabi niyang bukas siya sa pakikipagsundo kay dating Pangulong Duterte at pamilya niya para sa pambansang pagkakaisa.
