Panukalang mabigat na parusa sa preso na mahuhulihan ng iligal na droga, armas inaprubahan ng Kamara

BILANG na ang mga araw ng mga convicted drug lord na patuloy sa kanilang iligal na gawain kahit na nasa loob ng bilangguan.

Ito ay matapos na aprubahan ng Kamara de Representantes ang pagpapataw ng 40 taong kulong at P10 milyong multa sa mga bilanggo na mahuhulihan ng iligal na droga at iba pang kontrabando.

Sa botong 208, kinatigan ng mga mambabatas ang pag-apruba sa House Bill (HB) No. 9153, o “Contraband Detection and Control System Act.”

Kasama sa panukala ang paglikha ng detection at control system sa mga kulungan upang mahuli ang mga lalabag.

“This will have a chilling effect on our PDLs (persons deprived of liberty). At the same time, we’re telling them that we’re sincere and serious in giving them a new life away from danger, that is why we’re helping them get rehabilitated,” sabi ni Speaker Ferdinand Martin G. Romualdez.

“We mean business here because these crimes have always been recurring in practically all administrations. We have to have a culture of discipline and order once and for all. We also hope to reduce, if not end, gang wars inside prison facilities,” diin ni Speaker Romualdez, lider ng mahigit 300 kongresista

Pangunahing iniakda ni Surigao del Norte 2nd District Rep. Robert Ace Barbers, chair ng House Committee on Dangerous Drugs, ang panukala.

Inilatag sa panukala ang 11 kategorya ng kontrabando gaya ng iligal na droga, armas, pampasabog, alcohol o nakalalsing na inumin, sigarilyo, tabako, vape, lahat ng uri ng currency at pera, electronic communication devices, at luxury items gaya ng appliances, pang-sugal, at alahas.

“This will serve as a deterrent to those inmates or detention prisoners where drugs and crimes have been a part of their lives – inside or outside of prison. The measure will put a stop to their nefarious activities, where they are transacting drug deals even inside prison,” ani Barbers. 

Sinomang magtatangkang magpasok o magpuslit ng iligal na droga armas at pampasabog ay papatawan ng 20  taon hanggang 40 taong pagkakakulong at mula na P5 milyon hanggang P10 milyon.

Para sa mahuhulihan ng iba pang kontrabando, anim hanggang 12 taong pagkakakulong at multa na P1 milyon hanggang P5 milyon ang ipapataw.

Kung sangkot naman dito ang opisyal ng gobyerno, jail authority o empleyado, mahaharap din sila sa perpetual absolute disqualification sa paghawak sa anomang posisyon sa gobyerno at babawiin din ang kanilang retirement benefits at naipong leave credits.

Kabilang din sa ituturing na iligal na kagamitan ang mga gamit na may banta sa kaligatasan, seguridad at kalusugan ng mga tao sa correctional institusyon o anomang maaaring magamit para sa pagpa-plano, pagtulong at pagsasagawa ng pagtakas.

Kumpiyansa si Barbers na mahihinto ang paglipana ng mga kontrabado sa mga kulungan oras na ang mga ahensya ng pamahalaan at lokal na pamahalaan na namamahala sa alinmang correctional, custodial, o detention facility ay makapagpapatupad ng CDCS. 

Bahagi nito ang modernong teknolohiya, mga device o unit tulad ng handheld at walk-through metal detectors, X-ray scanners, at K9 units.

“All personnel in charge of the entry to correctional, custodial or detention facilities shall conduct an effective contraband detection and control procedure using CDCS technologies and devices, in addition to the traditional methods of searching any person, including their personal effects and belongings, entering such facilities,” nakalahad sa panukala

Nakasaad sa Section 7 ng panukala ang mga ipinagbabawal na gawain gaya ng: a) pagpasok o pagtatangkang ipasok ang kontrabando sa alinmang correctional, custodial, o detention facility; b) Tumulong para ipasok ang kontrabando; c) pagkakaroon o tangkang pagkakaroon ng kontrabando habang pinagsisilbihan ang sintensya at d) kabiguang magrehistro bago pumasok sa correctional, custodial o detention facility.
