THE Department of the Interior and Local Government (DILG) has urged local government units (LGUs) to pass ordinances that support the enforcement of national laws regulating tobacco, vapor, and vaporized nicotine products.
In a memorandum circular, the DILG stressed that local legislation must align with national laws, and LGUs must not set separate standards on the sale, manufacture, and distribution of these products.
LGUs are directed to actively enforce Republic Act (RA) 9211 (Tobacco Regulation Act of 2003), RA 11900 (Vaporized Nicotine and Non-Nicotine Products Regulation Act), RA 10643 (Graphic Health Warning Law), and related laws including RA 11467 and RA 10351.
They are also encouraged to adopt rules on smoke-free environments, designated smoking areas, and the display of graphic health warnings.
The DILG reminded LGUs of the ban on the use of vaporized and non-nicotine products in indoor public areas like elevators and stairwells, and the prohibition of sale to non-smokers and persons under 21.
LGUs are also expected to coordinate with the Bureau of Internal Revenue on enforcing the floor price or minimum price for vapor products and nicotine salts in local markets.
