TILA lumalampas na umano sa kaniyang kapangyarihan si Depatment of Transportation (DOTr) Secretary Jaime Bautista sa kaniyang kautusan na iwasang singilin ang container deposits mula sa mga broker, at sa halip ay mag-subscribe sa Container Ledger Account (CLA), ayon sa isang source mula sa logistics industry.

Giit niya, ang Office of the Secretary ay mayroon lamang direct line supervision at kontrol sa mga regional offices ng departamento.
Ang DoTr ay dapat umanong responsable para sa pagbuo at pagpapatupad ng mga patakaran, plano, programa, at proyekto ng departamento.
Sinabi ng source, inamin ni Anti-Red Tape Authority (ARTA) chief, Atty. Ernesto V. Perez na hindi umano sumailalim ang CLA sa Regulatory Impact Assessment nila.
“The CLA is not being imposed by way of regulation by a government agency. But if a stakeholder can show that (the regulation) is being imposed by a government agency-DoTr, then we can ask that it be subjected to an RIA. Otherwise, if it is only an option and the shipping lines are not required to use the CLA, then there is no regulation by DoTr to be subjected to RIA,” paliwanag ng source.
Giit niya, ang pinakamalapit na ahensya na may awtoridad sa mga shipping lines, bukod sa Phillpine Ports Authority (PPA) ay ang Marina.
Bukod dito, binanggit ng source mula sa ulat ng PortCalls na 20 shipping lines na ngayon ang mga subscriber ng CLA, kabilang ang COSCO Shipping Lines (Phils.) Inc., Sinotrans (Uni-ship), Hyundai Merchant Marine (Philippines) Co. Inc., at Kyowa Shipping Lines (Skybest Logistics).
Aniya, ang iba pang shipping lines na kasalukuyang naka-subscribe sa CLA ay kinabibilangan ng BLPL Singapore, CK Line, Concorde Container, Eagle Express Lines Inc. (RCL South Phils.), Federated Cargo Line, Lancer Container, Macro Ocean Philippines Inc., MBF Carpenters, New Zealand Line, Oceanus Container, OOCL Philippines Inc., Samudera Shipping, Sarjak Container Lines, Southern Star Agencia Maritima Inc. (Namsung Shipping), KMTC (Phils.) Corp., at RCL Feeders Phils. Inc.
Sinabi ng source na karamihan sa mga subscriber ng CLA ay may close alliance sa Association of International Shipping Lines (AISL).
“You can check all those shipping lines that signed up with CLA. If not most, all have only one ship agent, AISL President Patrick Ronas. Not all shipping lines are AISL members. With this DoTr directive, they require all shipping lines to adopt the AISL system,” dagdag ng source.
Nabatid na ang CLA ay isang online na sistema na naglalayong pasimplehin at pabilisin ang mga refund ng deposito sa container.
Aniya, 19.86 percent lang ng shipping lines ang naka-subscribe sa CLA at nais din nilang pumasok dito ang natitirang 80 porsiyento.
Sabi ng source, ang AISL ay itinutulak ang pagpapatupad ng CLA mula pa noong 2021 upang kontrahin ang pagganap ng PPA Administrative Order No. 04-2021 o ang Trusted Operator Program- Container Registry and Monitoring System (TOP-CRMS).
Sa ngayon, ipinagpaliban ang pagpapatupad ng TOP-CRMS ng PPA Board na pinamumunuan ni Bautista, na umanoy sinasabing solusyon sa sobrang pagsingil ng mga container deposit ng mga international shipping lines, na nagkakahalaga ng halos P23 bilyon sa industriya ng logistik noong 2022 lamang.
