IBINASURA ng Makati City Prosecutor’s Office ang kasong isinampa kay Bacolod City Representative Albee Benitez ng kanyang dating asawa na si Dominic “Nikki’ A. Lopez dahil sa kakulangan ng ebidensiya.
Sa inilabas na resolusyon ng Makati City Prosecutor’s Office na inilabas noong Hunyo 23, 2025 sa isinampang reklamo ni Dominic “Nikki’ A. Lopez laban kay Alfredo “Albee” Bantug Benitez dahil sa paglabag sa Section 5(e) (2) at (1) ng Republic Act 9262 na kilala bilang Violence Against Women and their Children Act of 2004.
Nakasaad sa resolusyon, “On a final note, while this office commiserates with whatever complainant has gone through, the office has to take consideration the lack of evidence to support her case of violation of RA 9262. Under the provision of D.C. No. 15, the evidence required exacts more than probable cause i.e prima facie evidence with reasonable certainty of conviction of the accused when the case is tried in court.”
Napansin din ng mga Prosecutor na karamihan sa mga ebidensyang ipinakita ng nagrereklamo ay lahat ng sabi-sabi , batay sa mga pahayagan at online materials na walang probative value.
“Wherefore, it is respectfully recommended that the complaint for RA No. 9262 otherwise known as Violation Against Women and their Children against respondents Alfredo “Albee” Bantug Benitez be dismissed for insufficiency of evidence,” base pa sa resolusyon na nilagdaan ni Assistant City Prosecutor Mikhail Maverick P. Tumacder at inaprubahan ng Senior Assistant City Prosecutor Melvin A. Matti, acting city prosecutor .
Sa kanyang pahayag, sinabi ni Benitez na ang dismissal ng kasong ito ay isang manipestasyon na patuloy na umiiral pa rin ang hustisya sa bansa.
Hinihiling din ni Cong Benitez sa media at sa publiko na matuldukan na ang usaping ito upang bigyan sila ng espasyo at privacy.
